Marathon, Linn Energy CEOs jump up HBJ's executive compensation list

Click through for a slideshow of the top five executives on the Highest-Paid Executives of Public Companies list.

Clarence Cazalot, chairman, president and CEO of Marathon Oil Corp. (NYSE: MRO), jumped up Houston Business Journal?s Highest-Paid Executives of Public Companies list from No. 15 last year to No. 1 this year.

The list is ranked by total compensation, and Cazalot?s increased 208.8 percent from last year ? the largest increase of any executive on the list.

Mark Ellis, president and CEO of Linn Energy LLC (NYSE: LINE), ranks No. 16, but his 94.9 percent increase was the second-highest on the list.

Also of note, this year?s list includes only one executive per public company, so more companies are represented. Equilar, an executive compensation data firm, provided data for the list.

Carcinogen in Mojave groundwater could require costly treatment

The Mojave Desert groundwater thatCadiz Inc.wants to sell to Southland suburbs contains hexavalent chromium, a carcinogen, in amounts that are hundreds of times greater than the state's public health goal for drinking water.

The presence of the toxic heavy metal, which occurs naturally in the aquifer Cadiz proposes to tap, could force the company to undertake expensive treatment, driving up the cost of the project and ultimately the price of its water.

The chromium contamination is one of several concerns raised by the Metropolitan Water District of Southern California, which owns and operates the 242-mile-long Colorado River Aqueduct that Cadiz would use to transport its supplies to customers.

Metropolitan has also informed Cadiz that the aqueduct space the company is counting on may not always be available, especially during dry years when demand for the Cadiz water would likely be the greatest.

The issues, described in environmental documents released last week, add to the hurdles Cadiz faces as it pursues a project that would push the boundaries of California's nascent private water market.

They also underscore that though the company is promoting its water as an alternative to imported supplies threatened by drought and environmental restrictions, its groundwater would also be imported 200 miles from the eastern Mojave to coastal customers and could be subject to delivery limits.

"Our aqueduct is probably the most valuable possession we have. So we're going to be extremely careful," said Jeffrey Kightlinger, general manager of Metropolitan, which built the aqueduct and has for decades used it to convey Colorado River supplies to millions of Southern Californians.

Metropolitan and Cadiz have a complicated history. More than a decade ago they planned a major water storage and pumping project in the Mojave that the Metropolitan board voted down in 2002, killing the proposal. Cadiz subsequently sued the agency, waging a costly legal battle that ended when it dropped the lawsuit shortly before a scheduled trial.

Now Cadiz needs Metropolitan's approval for use of the aqueduct, which is key to its latest proposal to withdraw and sell enough groundwater from beneath its Mojave holdings near Amboy to supply 100,000 homes each year. The sales could reap $1 billion to $2 billion in revenue for Cadiz over the life of the project.

The proposal has drawn opposition from U.S. Sen. Dianne Feinstein (D-Calif.), a powerful Mojave advocate, conservation groups and desert residents who fear the pumping will harm the environment of surrounding public lands, including the Mojave National Preserve.

An international company that operates industrial salt works at neighboring dry lakes has filed two lawsuits to block the project and environmental groups are expected to file more legal challenges.

There are currently no federal or state standards for hexavalent chromium, also known as chromium 6, in drinking water. But the state, citing international research that drinking water exposure has been linked to an increase in stomach tumors and liver cancer deaths, last year set a public health goal that will be used in the development of a regulatory standard.

At 14 parts per billion to 16 parts per billion, the chromium 6 levels in the Cadiz water far exceed the public health goal of .02 parts per billion. The ultimate state standard, expected in two to three years, will undoubtedly be higher than the health goal. But even if Cadiz supplies meet the new standard, Metropolitan could still require treatment before the groundwater is pumped into the aqueduct.

"Just having some [chromium 6] in our water could be a detriment to some of our folks," Kightlinger said, noting that some Southland cities blend Metropolitan supplies with their own chromium-tainted groundwater to reduce pollution levels. "We would have to do more analysis and see what the final standard is and do some modeling" before deciding whether treatment by Cadiz would be required, he added.

Scott Slater, president and general counsel of Cadiz, said chromium treatment could cost as much as $400 an acre-foot. "The worst case would be that we had to treat at every individual well," he said, adding that the company hopes some form of limited treatment combined with blending the groundwater with river water in the aqueduct would suffice, bringing costs to below $150 an acre-foot. (Cadiz proposes to pump an annual average of 50,000 acre-feet.)

Whatever the costs, they would be covered by contract provisions, Slater said. "The price of the water could go up or the profits of the company could go down."

He dismissed Metropolitan's suggestion that there might not be enough room in the aqueduct to accommodate Cadiz shipments, noting that long-term drought in the Colorado River basin has reduced the agency's deliveries.

"The Colorado River Aqueduct has not been full since 2003," he said. "I don't think that you can?project forward and come to the reasonable conclusion that the aqueduct's not going to be able to take 50,000 acre-feet of water."

But Kightlinger said Metropolitan has spent the past decade developing supplementary programs, such as acquiring irrigation water and holding supplies in Lake Mead, that could fill the aqueduct in dry years.

"We would pull [the Mead water] and say there is no wheeling capacity available. We've filled up our aqueduct," Kightlinger said. "That's just something they need to understand."

Google clarifies shipping dates for remaining Nexus 7 orders

Google has updated their Google Play support page for questions about Nexus 7 order and delivery, and have given some solid shipping dates. All orders placed before July 13 will be processed and shipped "soon". Here's the breakdown for orders from the US, Canada, the UK, and Australia:

• In the US: We’ve shipped all standalone Nexus 7 8GB orders (e.g.: those without a case, charger or Nexus Q). By the end of day on July 19 (PDT), we will have shipped all standalone Nexus 7 16GB orders placed through July 11 (PDT), and upgraded these orders to overnight shipping. We will process the remaining standalone Nexus 7 16GB orders by the end of next week with overnight shipping.
• If you ordered your tablet with a case, charger or Nexus Q, your Nexus 7 will ship this week with overnight shipping, in some cases ahead of the rest of your order. But don’t worry, the rest of your order will be on its way soon.
• In Canada: We’ve shipped all Nexus 7 8GB orders. We are in the process of shipping Nexus 7 16GB orders and will ship them in 1-2 weeks.
• In the UK: All Nexus 7 8GB orders will ship by July 20 (BST). All Nexus 7 16GB orders placed through June 30 (BST), will ship by July 20 (BST). The remaining Nexus 7 16GB orders will ship next week.
• In Australia: All Nexus 7 8GB and Nexus 7 16GB orders will be fulfilled by the end of day on July 19 (AEST) and will arrive in 3-5 days.

As the UK starts to recover from the financial crisis, many people are continuing their home improvements that may have been put off. In truth though, many homeowners have continued to undergo DIY projects despite the economic problems as they looked for ways to improve the look and ultimately, the value of our homes. Kitchen improvements can be considerably more expensive than bathroom improvements as to make a difference in the kitchen you often have new appliances installed or an overhaul of the current design which can be very costly.

However, in the bathroom you can make a big change by spending relatively little money. Painting and decorating in the bathroom is the most popular choice for many people as it is inexpensive and can have a nice effect on the look and feel of a bathroom. New Delhi: Leaders of Indian industry in their meeting with PMEAC Chairman C Rangarajan today pressed for an economic revival package, expeditious reforms and cut in interest rates to arrest slowdown.

Representatives of the three apex chambers CII, Assocham and PHDCCI also raised the issues of high interest rates, liberalisation of FDI regime and implementation of the Goods and Service Tax (GST) regime.

"...there is an urgent need to create conditions for revival of private investment by...further reduction in repo (short-term lending) rate by 100 basis points, and reduction of Cash Reserve Ratio (CRR) by 100 basis points", CII President Adi Godrej told reporters after the meeting .

The Reserve Bank, which opted for status quo in its last policy last month, is scheduled to review the monetary policy on July 31.

Rangarajan, himself a former RBI governor, and key aide of Prime Minister Manmohan Singh met the industry chambers to help the Government firm up

Microsoft's Ballmer says they'll never again leave any space for Apple

Microsoft's bombastic CEO, Steve Ballmer, has "thrown down the gauntlet" at Apple, and while acknowledging they'd ceded innovation in the past, they'd not be doing that again. According to comments provided to CRN following Microsoft's Worldwide Partner Conference in Toronto, Ballmer said:

But we are not going to let any piece of this [go uncontested to Apple]. Not the consumer cloud. Not hardware software innovation. We are not leaving any of that to Apple by itself. Not going to happen. Not on our watch.

While Steve Ballmer has been successful in maintaining Microsoft's Office and Windows profits (Vista hiccups not withstanding), and managing, if expensively, to get into gaming with Xbox, Ballmer's attempts to be keep Microsoft relevant in the white-hot internet and mobile markets have been disappointing to say the least.

Now with Nokia as their primary handset partner, and Windows Phone 8 ready to hit the market, and with Microsoft making their own Surface hardware to try to compete with Apple's iPad, clearly a new strategy is in place.

And for Ballmer, at least, it's vital that it works. Having former CEO Bill Gates remain as Chairman of the Board has probably insulated Ballmer from much of the pushback on his internet and mobile strategies to date, but even that can't last forever. Apple has a new CEO with Tim Cook. RIM has a new CEO with Thorsten Heis. Google has a new CEO with Larry Page.

Palm didn't survive their transformation. RIM's is by no means certain. Microsoft has several viable businesses and billions and billions in revenue to keep financing their failures, but they're a public company and their shareholders might not be happy with their firehose staying on full forever.

Ballmer can be as bombastic as he likes in interviews, but if he doesn't start nailing internet and mobile, Apple space or no Apple space, billions in the bank or no billions in the bank, Microsoft might be next in line for a management shake up.

How behavioral science can improve tax policy

Tax policy is ultimately about changing the way people behave. And to do that, you need to understand more than just economics. It's not enough to limit the "tyranny of lawyers." Effective reform requires to cooperation of both lawyers and economists.

That makes for better policy than a tyranny of lawyers alone. But it certainly isn?t enough. Policy is ultimately about changing the way people behave. And to do that, you need to understand more than just economics (as an increasing number of economists, Thaler foremost among them, already recognize).

Thaler thus makes two important suggestions: First, he argues that behavioral scientists deserve a greater formal role in the policy process, perhaps even a Council of Behavioral Science Advisers that would advise the White House in parallel with the Council of Economic Advisers. Second, he urges government to engage in more experimentation so it can learn just what policy choices best drive behavior, and how.

As an example, he cites the efforts of Britain?s Behavioral Insights Team, which was created when David Cameron?s coalition government came to office in 2010.

As its name implies, the team (which he advises) works with government agencies to explore how behavioral insights can make policy more effective. Tax compliance is one example.

Each year, Britain sends letters to certain taxpayers?primarily small businesses and individuals with non-wage income?directing them to make appropriate tax payments within six weeks. If they fail to do so, the government follows up with more costly measures. Enter the Behavioral Insights Team:

The tax collection authority wondered whether this letter might be improved. Indeed, it could.

The winning recipe comes from Robert B. Cialdini, an emeritus professor of psychology and marketing at Arizona State University, and author of the book ?Influence: The Psychology of Persuasion.?

People are more likely to comply with a social norm if they know that most other people comply, Mr. Cialdini has found. (Seeing other dog owners carrying plastic bags encourages others to do so as well.) This insight suggests that adding a statement to the letter that a vast majority of taxpayers pay their taxes on time could encourage others to comply. Studies showed that it would be even better to cite local data, too

Letters using various messages were sent to 140,000 taxpayers in a randomized trial. As the theory predicted, referring to the social norm of a particular area (perhaps, ?9 out of 10 people in Exeter pay their taxes on time?) gave the best results: a 15-percentage-point increase in the number of people who paid before the six-week deadline, compared with results from the old-style letter, which was used as a control condition.

Rewriting the letter thus materially improved tax compliance. That?s an important insight, and I hope it scales if and when Britain?s tax authority applies it more broadly.

But there?s a second lesson as well: the benefit of running policy experiments. Policymakers have no lack for theories about how people will respond to various policy changes. What they often do lack, however, is evidence about which theory is correct or how big the potential effects are. Governments on both sides of the Atlantic should look for opportunities to run such controlled experiments so that, to paraphrase Thaler, evidence-based policies can be based on actual evidence.

The hottest convertibles of the year

The Porsche Boxster S is an entry-level coupe suitable for middle-aged accountants and dentists, right? Not exactly.

Think more along the lines of James Dean.

?It?s a sexy car because of him,? Porsche spokesman Dave Engelman says. The $64,100 coupe is said to evoke the iconic Porsche 550 Spyder driven by the ?Rebel Without A Cause? star. ?They were designed as all-out sports cars with no compromise.?

Indeed. Not that Joe the Accountant couldn?t drive it, of course, but the Boxster offers so much more than that. Three hundred fifteen horsepower and a 0-60 mph time of 4.7 seconds are nothing to laugh at. Not to mention a top speed of nearly 175 miles per hour.

And if you ask a pro he?ll tell you that for most civilians, the mid-engined Boxster is much more fun to drive on the track than its 911 sibling.

?The Boxster is a great car ? it?s way more manageable than the 911,? Patrick Long told me once at a party in New York. He would know ? Long drives the Porsche 911 GT3-RSR for Flying Lizard Motorsports in the American Le Mans Series.

All this to say that the Boxster S is a perfect fit for our list of 10 hot convertibles on the market this summer.

This year?s group includes cars from the likely suspects (think Aston Martin, Bentley, Mercedes-Benz) along with a few surprises. Some are impractical but exceedingly attractive. Others look more demure and will work for a weekend jaunt with friends. But they?re all relatively expensive ? the $60,000 Ford Shelby GT is the cheapest thing on the list ? and muscle-car buffs and exotics-lovers alike will agree they?re all hot rides. (We chose the winners on this list from model-year 2012 or newer cars.)

To drop or not?
Convertibles have been around for more than a century (they were the original horseless carriages, after all ? just ask Gottlieb Daimler) but once conventional vehicles came about their popularity waned. Sales nationwide may actually be slipping even more, thanks to the growing popularity of panoramic sunroofs and targa tops.

According to the research firm RL Polk, convertible sales typically account for nearly 2 percent of the auto market but were running closer to 1.2 percent last year. The Chevrolet Camaro was the top-selling convertible last year, accounting for 7,530 car registrations. The Ford Mustang was second, with convertible sales of 6,645.

On the luxury side, the highest-selling convertible, the Mercedes-Benz E-Class, sold just of 3,446 units last year; the BMW 328 convertible sold just 2,867 units. But convertibles are still an important part of each brand, says Lonnie Miller, an analyst for Polk, because they act as ?halo? vehicles ? they attract attention and excitement. Even if someone doesn?t actually buy the roadster they walk into a showroom to drool over, at least it got them into the showroom.

?It?s a feel-good car,? Miller says.

Hard or soft?
For those who do opt to drop-top, the biggest question often comes down to form: Which is better, a soft top or a hard top? Switch from a cloth top to hard top in any given cabriolet and it?ll affect everything ? performance, structural soundness and (most importantly for many consumers) aesthetics ? because of the difference in weight and structure. Each style has its merits ? it just depends on what you want.

Hard tops like the one available in the $105,500 Mercedes-Benz SL550 are quieter and more durable, especially for drivers who live in cold climates. They?re also generally accepted as better-looking when the top is raised. But they?re also heavier, which means hardtop cars are slower and less fuel-efficient than they would be with cloth tops.

A cloth top on something like Ford?s Shelby Mustang means more space in the trunk and a lighter (more efficient) vehicle. It?s well-suited to drivers who won?t likely need to put up the roof very often. But they often look dingy and cheap when they?re deployed, and they?re usually more complicated to engage than the push-button hardtop. They also tend to be slightly louder than something hard, despite huge gains in recent years to make the seals more sound-proof.

One of the best in the ragtop range is Bentley?s arch Continental GTC. It has 500 horsepower, with a top speed of 195 miles per hour and a 0-to-60 sprint time of 4.5 seconds. Inside it has unique bulls-eye air vents and wood-framed organ stop controls, Mulliner diamond-quilted leather seats and a three-spoke leather steering wheel with aluminum inlays. Price: Just under $200,000, for the base version.

It?s a handsome car, to be sure. There?s just one catch, and it goes for everything on this list: The Continental goes faster with the roof up.
